Terms of Service

Placeholder — requires attorney review before public launch. This document is a plain-language draft to communicate intent. It is not legal advice and must be reviewed and finalized by qualified counsel in your jurisdiction before you rely on it publicly.

These Terms of Service govern your access to and use of the MarketingFlow Lens platform and related websites, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these terms.

1. The Service

MarketingFlow Lens is a marketing workspace for planning, creating, approving, publishing, and measuring campaigns. Certain features rely on integrations with third-party platforms (for example, ad networks, analytics providers, and email services).

2. Accounts and organizations

You must provide accurate account information and keep credentials secure. Organizations are responsible for the actions of their members and for maintaining the confidentiality of any content posted or published through the Service.

3. Subscription fees and advertising spend

Subscription fees do not include advertising spend. Media budgets you allocate to third-party ad platforms (such as Meta, Google, LinkedIn, or email providers) are billed separately by those platforms or, where applicable, invoiced by us as pass-through cost. Subscription and advertising budgets are always accounted for separately.

4. No guarantee of advertising results

We do not guarantee advertising outcomes. Reach, engagement, leads, conversions, revenue, follower counts, and return on ad spend depend on many factors outside our control — including creative, budget, audience, seasonality, competition, and third-party platform policies and algorithms.

5. Client responsibility for content

Clients are solely responsible for reviewing, approving, and publishing all content and claims. This includes assertions about products, pricing, availability, comparisons, endorsements, health/finance/legal claims, and any regulated statements. You must ensure all published content is accurate, non-deceptive, and compliant with applicable laws and platform policies.

6. Rights in uploaded media

You must own or hold a valid license for every asset you upload — including images, video, audio, fonts, trademarks, logos, and copy. You grant us a limited license to host, process, and display such assets solely to operate the Service on your behalf.

7. Third-party platforms

Third-party platforms may reject, suspend, remove, or throttle advertisements, posts, or accounts at their discretion. Availability and performance of the Service also depend in part on third-party services that we do not control. We are not liable for third-party outages, policy changes, or enforcement decisions.

8. AI-generated content

The Service includes AI-assisted content generation. AI output may be inaccurate, biased, or unsuitable. All AI-generated content must be reviewed by a human before use. See our AI Content Disclaimer.

9. Managed services

Fully managed marketing engagements may require a separate statement of work describing scope, deliverables, fees, and service levels. In case of conflict, the statement of work controls for that engagement.

10. Acceptable use

Use of the Service is subject to our Acceptable Use Policy.

11. Termination

Either party may terminate for material breach. Cancellation and refund handling are described in our Subscription and Cancellation Policy.

12. Disclaimers and limitation of liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, to the maximum extent permitted by law. To the extent permitted by law, our aggregate liability is limited to the subscription fees you paid in the twelve months preceding the claim. Nothing in these terms excludes liability that cannot be excluded under applicable law.

13. Changes to these terms

We may update these terms from time to time. Material changes will be communicated in-product or by email before they take effect.
